The International Health Certificate must be submitted together with the visa application form. The traveller will also have to present the said certificate to the Immigration Officer upon arrival at the port of entry in the Kingdom. As for those nationals of the countries listed below but who have not travelled from/through those countries, such a certificate is not required. However, they should possess concrete evidence showing that their domicile is not in an infected area so as to prevent unnecessary inconvenience. Holder of this type of visa is allowed to stay in Thailand for 1 year. Employment of any kind is strictly prohibited. 1. Eligibility 1.1 Applicant must be aged 50 years and over (on the day of submitting application). 1.2 Applicant not prohibited from entering the Kingdom as provided by the Immigration Act B.E. 2522 (1979). 1.3 Having no criminal record in Thailand and the country of the applicant’s nationality or residence. 1.4 Having the nationality of or residence in the country where applicant’s application is submitted. 1.5 Not having prohibitive diseases ( Leprosy, Tuberculosis, drug addiction, Elephantiasis, third phase of Syphilis) as indicated in the Ministerial Regulation No. 14 B.E. 2535. 2. Required Documents - Passport with validity of not less than 18 months. - 3 copies of completed visa application forms. - 3 passport-sized photos (4 x 6 cm) of the applicant taken within the past six months. - A personal data form. - A copy of bank statement showing a deposit of the amount equal to and not less than 800,000 Baht or an income certificate (an original copy) with a monthly income of not less than 65,000 Baht, or a deposit account plus a monthly income totalling not less than 800,000 Baht. - In the case of submitting a bank statement, a letter of guarantee from the bank (an original copy) is required. - A letter of verification issued from the country of his or her nationality or residence stating that the applicant has no criminal record (verification shall be valid for not more than three months and should be notarised by notary organs or the applicant’s diplomatic or consular mission). - A medical certificate issued from the country where the application is submitted, showing no prohibitive diseases as indicated in the Ministerial Regulation No.14 (B.E. 2535) (certificate shall be valid for not more than three months and should be notarised by notary organs or the applicant’s diplomatic or consular mission). - In the case where the accompanying spouse is not eligible to apply for the Category ‘O-A’ (Long Stay) visa, he or she will be considered for temporary stay under Category ‘O’ visa. A marriage certificate must be provided as evidence and should be notarised by notary organs or by the applicant’s diplomatic or consular mission. 3. Channels to submit application Applicant may submit their application at the Royal Thai embassy or Royal Thai Consulate-General in their home/residence country or at the Office of the Immigration Bureau in Thailand located on Soi Suan Plu, South Sathorn Road, Sathorn District, Bangkok 10120. Recommendations for foreigners with Non-Immigrant Visa “O-A” (Long Stay) while staying in the Kingdom 5.1 Upon arrival, holder of this type of visa will be permitted to stay in Thailand for 1 year from the date of first entry. During the one-year period, if he or she wishes to leave and re-enter the country, he or she is required to apply at the Immigration office for re-entry permit (single or multiple) before departure. In the case of leaving the country without a re-entry permit, the permit to stay for 1 year shall be considered void. 5.2 At the end of the 90-day stay , the foreigner must report to the immigration officer in his or her residence area and report again every 90 days during his or her stay in Thailand. The foreigner may report to the police station if there is no immigration office in his or her residence area. 5.3 Foreigner may report to the competent authority by post and should provide the following: - A report form (Tor Mor 47). - A copy of passport pages showing the foreigner’s photo, personal details, and the latest arrival visa stamp. - A copy of the previous receipt of acknowledgement. - A self-addressed envelope with postage affixed. Such documents must be sent to the Office of the Immigration Bureau, Soi Suan Plu, South Sathorn Road, Sathorn District, Bangkok 10120, and must be submitted 7 days before the end of every 90-day period. A receipt of acknowledgement will be given and should be used for future correspondence. 5.4 Foreigner who wishes to extend his or her stay shall submit a request for extension of stay at the Office of the Immigration Bureau with documented evidence of money transfer or a deposit account in Thailand or an income certificate showing an amount of not less than 800,000 Baht or an income certificate plus a deposit account showing a total amount of not less than 800,000 Baht. This type of visa may be issued to businessmen for multiple-entries and is valid for 3 years. It allows holder to visit Thailand as often as required for as long as the visa remains valid and allows holder to stay in Thailand for a period of not exceeding 90 days during each visit. Employment of any kind is strictly prohibited for holder of such visa. Place of application Application is to be submitted at the Royal Thai Embassy or the Royal Thai Consulate-General in the applicant’s country of residence, or at the Royal Thai Embassy which has jurisdiction over his or her country of residence. However, Royal Thai Consulate-General headed by Honorary Consul-General is not authorized to issue this type of visa. Applicant may enquire about authorized office for visa issuance at any Royal Thai Embassy or Royal Thai Consulate-General. Visa Issuance 1.1 Foreigners who wish to work, conduct business or undertake investment activities in Thailand must apply for a Non-Immigrant Visa at the Royal Thai Embassies or Royal Thai Consulates-General. Various categories of the Non-Immigrant Visa are currently provided to meet the needs and qualifications of individual business persons. These include business visa Category “B”, business-approved visa Category “B-A” and investment and business visa Category “IB”. Holder of this type of visa wishing to work in Thailand must be granted a work permit before starting work. The visa fee is 2,000 Baht for single-entry with three-month validity and 5,000 Baht for multiple entries with one-year validity. 1.2 Nationals of certain countries are required to apply for a visa only at the Royal Thai Embassy or Royal Thai Consulate-General in their home/residence country or at the designated Royal Thai Embassy or Royal Thai Consulate-General. Travellers are advised to contact the nearest Royal Thai Embassy or Consulate-General to find out where they may apply for a visa to Thailand before departure. Application for Visa 2.1 Non-Immigrant Visa Category “B” (Business Visa) is issued to applicants who wish to enter the Kingdom to work or to conduct business. (1) Foreigners who wish to work in Thailand must provide the following documents: - Passport or travel document with validity of not less than 6 months. - Completed visa application form. - Recent passport-sized photograph (4 x 6 cm) of the applicant taken within the past 6 months. - Evidence of adequate finance (20,000 Baht per person and 40,000 Baht per family). - Letter of approval from the Ministry of Labour. To obtain this letter, the applicant’s prospective employer in Thailand is required to submit Form WP3 at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour Tel. 02-2452745, or at the Provincial Employment Office in his or her respective province. N.B. - An alien who receives a Non-Immigrant visa can work in Thailand once he or she is being granted a work permit. An alien in violation of the Immigration Act B.E. 2522 (1979) concerning taking up employment without work permit or the Royal Decree B.E. 2522 (1979) concerning holding employment in certain restricted occupations and professions shall be prosecuted and imprisoned or fined, or shall face both penalties. - It is recommended that the applicant should apply for visa at the Thai Embassy/ Consulate in the country where he/she has the residence (2) Foreigners who wish to conduct business in Thailand must provide the following documents: - Passport or travel document with a validity of not less than 6 months. - Completed application form. - Recent passport-sized photograph (4 x 6 cm) photograph of the applicant taken within the past 6 months. - Evidence of adequate finance (20,000 Baht per person and 40,000 Baht per family) for the duration of stay in Thailand - Letter from the applicant’s company indicating the applicant’s position, length of employment, salary and purpose of visit(s) to Thailand. - Documents showing correspondence with business partners in Thailand. - Evidence of financial status in the case where the applicant is self-employed. - Letter of invitation from trading or associated partners/companies in Thailand. - Corporate documents of associated partners/companies in Thailand such as: 1) business registration and business license 2) list of shareholders 3) company profile 4) details of business operation 5) map indicating location of the company 6) balance sheet, statement of Income Tax and Business Tax (Por Ngor Dor 50 and Por Ngor Dor 30) of the latest year 7) value-added tax registration (Por Por 20) (3) Copies of company documents must be signed by the Board of Directors or authorised managing director and affix seal of company. (4) Additional documents may be requested as and when necessary. In the absence of a required document, applicant must provide a letter explaining the unavailability of such document. Applicant must endorse on each and every page of the submitted copies of documentation. Documents in foreign languages must be translated into Thai and should be notorised by notary organs or by the applicant’s diplomatic or consular mission. (5) Holder of this type of visa is entitled to stay in Thailand for a maximum period of 90 days. He or she may apply for an extension of stay at the Office of the Immigration Bureau and may be granted such extension for a period of one year from the date of first entry into Thailand. 2.2 Non-Immigrant Visa category “B-A” (Business Approved Visa) The granting of such visa to qualified applicants is under the jurisdiction of the Office of the Immigration Bureau in Bangkok. The applicant’s associated company in which he or she will invest in or conduct business with may apply for this type of visa on behalf of the applicant at the Office of the Immigration Bureau. Once the application is approved, the Immigration Bureau will advise the concerned Royal Thai Embassy or Royal Consulate-General via the Ministry of Foreign Affairs to issue the visa to the applicant. The holder of this category “B-A” visa will be permitted to stay for a period of one year from the date of first entry into the Kingdom. 2.3 Non-Immigrant Visa Category “IB” (Investment and Business Visa) is issued to foreign citizens employed to work on investment projects which are under the auspices of the Board of Investment of Thailand (BOI). Such projects must be involved in or bring benefit to Thailand in the following ways: - Export-promotion - Increasing employment - Utilising local raw materials - Projects engaging the provinces - Encouraging technology transfer to Thai nationals - Not hindering existing domestic businesses 2.4 Non-Immigrant Visa Category “B” (Teaching) Foreigners who intend to take up employment as school teachers at the levels below university level in Thailand must submit the following required documents: - Passport or travel document with validity of not less than 6 months - Completed visa application form - Recent passport-sized photograph (4 x 6 cm) of the applicant taken within the past 6 months. - Letter of acceptance from employing institute or school in Thailand. - Letter of approval from government agencies such as the Office of the Private Education Commission, the Office of the Basic Education Commission. - Evidence of educational qualification such as diplomas or teaching certificates. - School license or business registration, list of shareholders and school profile. - Applicant’s resume. - Police certificate verifying that applicant has no criminal record or equivalents or letter issued by authorised agencies in applicant’s country. (The requirement of the submission of such police certificate is optional. The applicant must submit it if consular officer requests he/she to do so. This requirement is effective as from May 2007) 3. Additional Information 3.1 Upon entry into the Kingdom, applicant or his or her appointed representatives must apply for a work permit at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour in which the applicant will be obligated to pay income tax accordingly. If the applicant’s associated company is located in the provinces, the applicant must apply at the Employment Office of that province. 3.2 Applicant’s family members (i.e., spouse, parents and children who are unmarried and under 20 years old) are eligible to apply for a Non-Immigrant Visa (category “O”) and will be allowed to stay for a period of 90 days but no longer than 1 year. 3.3 Foreign citizens who hold a Transit Visa (“TS”) or Tourist Visa (“TR”) and wish to engage in business activities in Thailand may apply for a change of type of visa (e.g., from Tourist Visa to Non-Immigrant Visa) at the Office of the Immigration Bureau Office located at Soi Suan Plu, South Sathorn Road, Bangkok 10120, Tel 02 2873101-10, www.immigration.go.th. The granting of change of type of visa and extension of stay is at the discretion of the immigration officer. 4. One Stop Service Centre for Visas and Work Permits 4.1 The One Stop Service Centre for Visas and Work Permits was established on 1 July 1997 by authority of the Regulations of the Office of Prime Minister promulgated on 30 June 1997. The objective of this centre is to simplify visa extension and permit issuance procedures to create a good investment environment. It aims to facilitate applications of visa extension and work permits (e.g., stay permission, re-entry permit, work permit). The Centre is located on 207 Rachadapisek Road, Krisda Plaza, Dindaeng, Bangkok 10310, Tel 02 693-9333 - 9 . 4.2 Foreigners who are eligible to apply for visa extension and work permits at the One Stop Service Centre are: (1) Foreigner who is an executive or expert with privileges accorded to them by the following laws: - Investment Promotion Act B.E. 2520 (1977) - Petroleum Act B.E. 2514 (1971) - Industrial Estate Authority of Thailand Act B.E. 2522 (1979) (2) Foreigner who is an investor. - If investing not less than 2 million Baht, he or she will be granted a 1 year permit. - If investing not less than 10 million Baht, he or she will be granted a 2 year permit. (3) Foreigner who is an executive or expert. - Foreigner’s associated company should be registered with capital or possess asset of not less than 30 million Baht. (4) Foreigner who is member of the foreign press must present a letter from the Ministry of Foreign Affairs and a copy of an ID Press Card issued by the Department of Public Relations. (5) Foreigner who is a researcher or developer on science and technology. (6) Foreigner who is employed in a branch office of an overseas bank, foreign banking office of an overseas bank, provincial foreign banking office of an overseas bank or a representative office of foreign bank in which all offices are certified by the Bank of Thailand. (7) Foreigner who works on the necessary and urgent basis for a period of no longer than 15 days. (8) Foreigner who is an official of the representative office for foreign juristic persons concerning the International Trading Business and Regional Office of Transnational Corporation in accordance to the Foreign Business Act B.E. 2542 (1999). (9) Foreigner who is an expert on information technology. (10) Foreigner who works at regional operating headquarters. 0 comment :: Add a comment By Bart, 10 June 2008 at 06:55:31 :: General Information Foreign visitors to Thailand without a visa are permitted to enter and stay in Thailand for tourism for a period of time not exceeding 30 days. If they want to extend their stay in Thailand, they will have to exit and re-enter the country. Other foreigners with a Visa (Non-immigrant, Transit, etc.) usually also have to exit and re-enter the country after a period of time (3 months, one year, etc.). Doing a Visa run is the action of leaving the country, getting a stamp from another country (enter and exit) and coming back to Thailand. This can be done in one day or in several days. Some Thai companies (travel agents) are specialized in organizing Visa runs. From Bangkok, the most famous destination is Cambodia, to either Poipet or Ban Laem border. A one day travel by bus or minivan is available. The travel agent takes care of your travel (round trip) and sometimes also takes care of the whole process of getting your passport stamped while you are having a lunch at the border. REQUIREMENT This type of visa is issued to applicants who wish to enter the Kingdom for the following purposes: - to perform official duties (Category "F") - to conduct business / to work (Category "B") - to invest with the concurrence of the Thai Ministries and Government Departments concerned (Category "IM") - to invest or perform other activities relating to investment, subject to the provision of the established laws on investment promotion (Category "IB") - to study, to come on a work study tour or observation tour , to participate in projects or seminars , to attend a conference or training course , to study as a foreign Buddhist monk (Category "ED") - to work as a film-producer, journalist or reporter (Category "M") - to perform missionary work or other religious activities with the concurrence of the Thai Ministries or Government Departments concerned (Category "R") - to conduct scientific research or training or teaching in a research institute (Category "RS") - to undertake skilled work or to work as an expert or specialist (Category "EX") - other activities (Category "O") as follows: to stay with the family, to perfrom duties for the state enterprise or social welfare organizations, to stay after retirement for the elderly, to receive medical treatment, to be a sport coach as required by Thai Government, to be a contestant or witness for the judicial process. 2. ("B") - Document indicating the number of foreign tourists (for tourism business only) ,or document indicating export transactions issued by banks (for export business only)("B") 2.2 The document to be submitted for non-immigrant visa application is contingent upon necessities and appropriateness of purposes stated in the application form. 2.3 Consular officers reserve the rights to request additional documents as deemed necessary. 2.4 Copies of company documents must be signed by Board of Directors and affixed the seal of the company. 2.5 In the absence of a required document, a letter explaining the unavailability of such document must be provided. 2.6 The applicant must sign on each page of the copy. 2.7 Documents in foreign languages must be translated into Thai. Generally, a foreign citizen who wishes to enter the Kingdom of Thailand is required to obtain a visa from a Royal Thai Embassy or a Royal Thai Consulate-General. However, nationals of certain countries do not require a visa if they meet visa exemption requirements as follows: (1) they are nationals of countries which are exempted from visa requirements when entering Thailand for tourism purposes. Such nationals will be permitted to stay in the Kingdom for a period of not exceeding 30 days. In general, applicants are required to apply for a visa in person. However, Royal Thai Embassies and Royal Thai Consulates-General in some countries and in some cases may also accept applications sent through representatives, authorised travel agencies or by post. Please enquire at the Royal Thai Embassy or Royal Thai Consulate-General where you intend to submit your application of acceptable ways of application. 7. Please note that the period of visa validity is different from the period of stay. Visa validity is the period during which a visa can be used to enter Thailand. In general, the validity of a visa is 3 months, but in some cases, visas may be issued to be valid for 6 months, 1 year or 3 years. The validity of a visa is granted with discretion by the Royal Thai Embassy or Royal Thai Consulate-General and is displayed on the visa sticker. 8. On the other hand, the period of stay is granted by an immigration officer upon arrival at the port of entry and in accordance with the type of visa. For example, the period of stay for a transit visa is not exceeding 30 days, for a tourist visa is not exceeding 60 days and for a non-immigrant visa is not exceeding 90 days from the arrival date. The period of stay granted by the immigration officer is displayed on the arrival stamp. Travellers who wish to stay longer than such period may apply for extension of stay at offices of the Immigration Bureau in Bangkok, located at Soi Suan Plu, South Sathorn Road, Bangkok 10120, Tel 02-2873101-10 or at an Immigration office located in the provinces. Foreigners entering Thailand are not permitted to work, regardless of their types of visa, unless they are granted a work permit. Those who intend to work in Thailand must hold the correct type of visa to be eligible to apply for a work permit. Information on Work Permit applications could be obtained from the website of the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour at www.doe.go.th/workpermit/index.html 10. Royal Thai Embassies and Royal Thai Consulates-General have the authority to issue visas to foreigners for travel to Thailand. The authority to permit entry and stay in Thailand, however, is with the immigration officers. In some cases, the immigration officer may not permit foreigner holding a valid visa entry into Thailand should the immigration officer find reason to believe that he or she falls into the category of aliens prohibited from entering Thailand under the Immigration Act B.E. 2522 (1979). 11. According to the Immigration Act of Thailand B.E. 2522 (1979), foreigners who fall into any of the following categories are prohibited to enter Thailand: (1) Having no genuine valid passport or document used in lieu of passport; or having a genuine valid passport or document used in lieu of passport without valid visa issuance by the Royal Thai Embassies, the Royal Thai Consulates-General or the Ministry of Foreign Affairs, with exception of those who meet visa exemption requirements. The terms and conditions of visa issuance and visa exemption are prescribed by the Ministerial Regulations. (2) Having no appropriate means of living following entry into the Kingdom. (3) Having entered the Kingdom to be employed as an unskilled or untrained labourer, or to work in violation of the Alien Work Permit Law. (4) Being mentally unstable or having any of the diseases stated in the Ministerial Regulations. (5) Having not yet been vaccinated against smallpox; or inoculated, or undergone any other medical treatment for protection against disease; and having refused to have such vaccinations administered by the Immigration Doctor. (6) Having been imprisoned by judgment of the Thai Court; or by lawful injunction or judgment of the Court of a foreign country, except for when the penalty is for a petty offence, or negligence, or is provided for as an exception by the Ministerial Regulations. (7) Having behaviour which could cause possible danger to the public; or having the likelihood of being a nuisance or constituting any violence to the peace, safety and security of the public or to the security of the nation; or being under warrant of arrest by competent officials of foreign governments. (8) Reason to believe that entry into Kingdom is for the purpose of being involved in prostitution, the trafficking of women or children, drug smuggling, or other types of smuggling which are against public morality. (9) Having no money or bond as prescribed by the Minister under Section 14 of the Immigration Act B.E. 2522 (1979). (10) Being a person prohibited by the Minister under Section 16 of the Immigration Act B.E. 2522 (1979).
